These claims include the following:

1) Living trusts, unlike wills, are private documents and never have to be made public, thus protecting one’s right to privacy.

2) Living trusts can save estate taxes that cannot be saved with a will.

3) One can completely avoid probate with a living trust.

4) By establishing a living trust, one’s assets are protected from creditors.

5) By using a living trust, benefits such as the right to disclaim, the right to elect the alternate valuation date and other similar benefits are not jeopardized.

6) The cost of a living trust is cheaper than probate after considering the time value of money.

7) After death, the claims of creditors are cut off with a living trust just like they are with a will.

8) The time allowed for challenging a living trust is the same as with a will.

9) The lack of a bond requirement for living trusts is a benefit.
